Federal Update: HIV Travel Restrictions Tightened
The Department of Homeland Security (DHS) recently changed the rules for travelers with HIV coming into the United States. The new rules would allow short-term visas for HIV positive people traveling to the US. Since 1993 a federal law has restricted travel and immigration to the United States by HIV positive people. There is a waiver process in place but it is a difficult.
The new rules allow for a 30 day visa for business or pleasure but the applicants must agree not to apply for a longer stay or permanent US residency. Rep. Barbara Lee (D-Calif.), along with two dozen other Democratic House members, sent a letter to the Department of Homeland Security (DHS) objecting to the changes. DHS said they would review the criticism in the letter and respond.
The proposed rule change for 30 day visas make the process nearly identical to the current regulations in place for applying for permanent residency. Through MAP’s years of experience helping people negotiate this waiver process for permanent residency, we have seen first-hand how confusing the requirements are and the great deal of time it takes an applicant to gather the necessary information.

AIDS Action Day is scheduled for Tuesday, March 18, 2008 at the State Capitol. Join HIV advocates from around the state to support HIV prevention policies. More information will be available in the coming months. We hope you are able to attend! The 2008 Legislative Agenda will be unveiled in the next MAP Advocate.

AIDS Action Day is an opportunity for HIV advocates to come to the State Capitol and meet with their legislators face-to-face. It is an exciting day that includes lobby training, issues briefing, a noon rally, and time to meet with your elected officials.
