Federal Update: PEPFAR Legislation Passes Congress and Signed by President Bush

Last week President Bush re-authorized the President's Emergency Plan for AIDS Relief (PEPFAR). The five-year, $48 billion bill will fight HIV, tuberculosis and malaria programs in Africa and other areas of the world ($5 billion for malaria and $4 billion for tuberculosis).

The new law also contains a provision that removes a 15-year statutory ban on the entry of people with HIV into the United States, a discriminatorily restrictive policy for HIV positive immigrants and travelers. However, the ban is not being lifted outright. While the statutory ban has been lifted, attentions now turn to an administrative ban. This means the Department of Health and Human Services (HHS) will have the authority to determine on a case-by-case basis whether someone's HIV status is grounds for denial of entry. HIV advocates will need to ensure that HHS eliminates the ban.

Some concerns with the bill are that it still contains ambiguous language about abstinence-only until marriage programs and makes no mention of family planning or reproductive health programs.

In The News: CDC Releases New HIV Infection Rates

On Sunday, August 3 the CDC (Centers for Disease Control and Prevention) announced a revised estimate of HIV incidence in the United States. The new estimate of approximately 56,000 annual infections will be published in the Journal of the American Medical Association (JAMA) and presented publicly at the International AIDS Conference in Mexico City. The revision also includes a back-calculation revealing that, for the last 15 years, infection rates were approximately 25 – 50% higher than the long-held 40,000 annual estimate. Most important, the new estimate demonstrates an imperative for the U.S. to invest in domestic HIV prevention programs, while the reality is that funding from the CDC has diminished in recent years.

Allan Spear Forum Featuring Gloria Reuben Recap

Thank you to all who attended the Allan Spear Forum featuring actress and HIV advocate Gloria Reuben. Attendees heard from Gloria about her experiences playing an HIV positive character on ER along with her perspective on the continuing challenges in addressing HIV in our society. Save the date for the next Allan Spear Forum featuring Regan Hoffman, editor of POZ magazine, on September 16, 7 p.m., at Westminster Church.
